的邻居是一家从1997年开始营运的集体面粉加工厂。其生产过程中产生的噪声、灰尘和洗麦子的废水严重影响到的日常生活和身体健康。多次与该厂交涉，才使其上了部分防污设施，但巨大的噪声和刺鼻呛人的麦灰使污染依旧。忍无可忍，于2004年到市环保局请求行政处理。在交了250元的“污染危害委检费”几个月后拿到了市环保局的处理决定。其监测结果为，工艺粉尘排放浓度超标0．4倍，噪声超标20分贝。 处理意见： 一是要苯面粉加工厂必须加强治理，达标排放； 二是要求面粉加工厂进一步采取措施减轻污染，包括将散发灰尘的车间安装门窗以免灰尘跑冒，将邻近住宅的厂房的天窗封闭以减轻噪声危害和粉尘污染； 三是要求工厂严格遵守早8点至晚18点的工作时间，特殊情况下，工作时间最迟不得超过22点。并告知，如对该处理决定不服，可依照《民事诉讼法》规定的程序向人民法院起诉。 认为该处理决定没有体现出他的合理要求，对他受到的健康损害没有给予补偿损失。但该环保局局长说：健康受到损害要求赔偿需要由卫生机构提供的证据，只说健康受到损害，但无具体损失的证据，环保局是无法决定给予赔偿的。环保局长的话有道理吗？
