某外贸公司接到国外开来的信用证,证内规定“数量共6000箱,1至6月份分六批装运,每月装运1000箱。”该信用证受益人在1至3月份每月装运1000箱,银行已分批议付了货款,对于第四批货物,原定于4月25日装船出运,但由于台风,该批货物延至5月1日才装船,当该公司凭5月1日的装船提单向银行议却遭银行拒付。该公司“不可抗力”为由要求银行通融也遭银行拒绝。试问:在上述情况下,开证行有无拒付的权利?我方有无引用“不可抗力”条款的权利?为什么?
